Anglonas 1.1, Licencinė vartotojo sutartis su gamintoju

Ši vartotojo licencinė sutartis yra teisinė sutartis tarp Jūsų (asmens ar organizacijos, toliau vadinamų „Jūs“ arba „Licenciatas“) ir UAB „Fotonija“, toliau vadinamos „Gamintoju“, dėl anglų-lietuvių kalbų kompiuterinio žodyno ANGLONAS kartu su spausdinta medžiaga, elektronine dokumentacija ir šriftu „Aistika“, toliau vadinamo „Produktu“. Produktas yra saugomas Lietuvos Respublikos autorių teisių ir gretutinių teisių įstatymo Nr. VIII - 1185 (1999 m. gegužės mėn. 19 d.) ir kitų įstatymų bei sutarčių dėl intelektinės nuosavybės teisių.

Šis Produktas Jums yra licencijuojamas, kaip vientisas kūrinys, todėl įsigydami Jūs netampate Produkto savininku, o tik įgyjate licencinėje sutartyje nurodytas naudojimo teises. Išpakuodami Produkto licencijos sertifikatą su unikaliu licencijos raktu, diegdami, kopijuodami ar kitaip naudodami šį Produktą, Jūs tuo pačiu besąlygiškai sutinkate su šios licencinės sutarties sąlygomis. Produktas ir bet kokios jo kopijos yra ir išlieka Gamintojo nuosavybė. Jūs sutinkate, kad Produktas yra programiškai apsaugotas ir gali būti naudojamas tik su Gamintojo ar jo įgaliojimu suteiktu licencijos raktu. Jokiomis aplinkybėmis Jūs ar bet kas kitas neturi teisės užblokuoti Produkto saugumą užtikrinančių kompiuterio programos komandų.

Jūs pripažįstate, jog pagal šią sutartį Jūs įgyjate tik šias neišskirtines teises:

galite įdiegti ir neribotą laiką naudoti Produktą viename kompiuteryje, jei kitoks kompiuterių skaičius nėra nurodytas Gamintojo išduotame licencijos sertifikate. Įdiegę Produktą į savo stalinį kompiuterį, Jūs savo patogumui galite papildomai įdiegti Produktą ir į Jums priklausantį nešiojamą kompiuterį, tačiau tokiu atveju Produktu naudotis gali tik asmuo, naudojantis Produktą staliniame kompiuteryje, o naudotis Produktu vienu metu abiejuose kompiuteriuose nėra leidžiama;
Jums leidžiama pasidaryti ir turėti vieną atsarginę Produkto kopiją, kuri nėra laikoma ar naudojama kompiuteryje;
visam laikui galite perduoti Produktą kitam vartotojui su sąlyga, kad Jūs jam perduosite šią sutartį, licencijos sertifikatą ir Produktą, įskaitant visas kopijas, atnaujinimus, ankstesnes versijas bei licencijos raktą, be to, Jūs daugiau nebesinaudosite Produktu ir nepasiliksite jo kopijos, o gaunantysis šį Produktą besąlygiškai sutiks su visomis šios licencinės sutarties sąlygomis.

Visas kitas teises Gamintojas pasilieka sau. Jums nėra leidžiama naudoti Produktą vienu metu keliuose kompiuteriuose, išskyrus šioje sutartyje nurodytus atvejus. Gamintojo licencija yra susieta su įdiegtu Produktu ir ja negalima naudotis pakaitomis skirtinguose kompiuteriuose. Jums nėra leidžiama licencijuoti trečiajam asmeniui, o taip pat išnuomoti, paskolinti, siųsti, publikuoti (įskaitant publikavimą internete), transliuoti ar kitaip platinti Produktą, bet kurią jo dalį arba licencijos raktą. Norėdami publikuoti Produktą ar skleisti jo veikimo rezultatus internete, plačios aprėpties tinkle, vietiniame ar bet kokiame tinkle, taip pat bet kokiomis komunikacijos priemonėmis, Jūs privalote sudaryti specialią licencinę sutartį su Gamintoju. Jūs negalite licencijos raktą, Produktą ar bet kurią jo dalį padaryti prieinamais bet kokia forma trečiosioms šalims, išskyrus nurodytus atvejus. Produkto sudedamųjų dalių neleidžiama atskirti ir naudoti atskirai. Kiek tai neprieštarauja įstatymams, Produktas negali būti apgrąžos inžinerijos objektu, jo negalima dekompiliuoti, išmontuoti ar kitaip atskleisti Produkto programos teksto ar duomenų. Jums nesuteikta teisė modifikuoti, adaptuoti, išversti Produktą ar jo pagrindu kurti kitus išvestinius kūrinius.

Jūs pripažįstate, jog Produkte gali būti riktų, jo turinys gali būti klaidingas, o Produkto veikimas ne visuomet sklandus. Produktas pateikiamas toks, koks yra – be jokių garantijų, nei tiesiogiai išreikštų, nei numanomų, o šiuo Produktu Jūs sutinkate naudotis išimtinai savo rizika. Kiek tai neprieštarauja įstatymams, Gamintojas ir jo tiekėjai neprisiima atsakomybės, kylančios iš sutarties ar delikto (įskaitant neatsargumą), Jums ar bet kokiai trečiai šaliai už tiesioginius ar netiesioginius, tyčinius ar netyčinius, atsitiktinius, pasekminius, baudžiamuosius ar bet kokius kitus nuostolius, įskaitant prarastą pelną, prarastas santaupas ar žalos atlyginimą, kurie atsirado naudojant šį Produktą ar yra siejami su šio Produkto naudojimu.

Jūs privalote supažindinti savo darbuotojus arba kitus asmenis, galinčius naudotis Produktu arba jo kopijomis Jūsų patalpose, su visomis šios licencinės sutarties sąlygomis ir užtikrinti, kad jie griežtai jų laikytųsi. Jei Jūs nesutinkate su šios Sutarties sąlygomis, nediekite Produkto, juo nesinaudokite ir ištrinkite jį iš savo kompiuterio. Bet kurios iš Sutarties sąlygų nesilaikymas automatiškai nutraukia šią licencinę sutartį. Nutrūkus licencinei sutarčiai, Jūs privalote tuojau pat ištrinti Produktą ir juo nebesinaudoti.

End-User License Agreement

This License Agreement is a legal agreement between you (either an individual or a single entity, and hereinafter referred to as "you" or "Licensee") and UAB FOTONIJA for English-Lithuanian-English computer dictionary ANGLONAS, font AISTIKA, printed materials and electronic documentation (hereinafter referred to as the "Product"). The software of the Product is protected by the Lithuanian law on copyright and related rights as well as by other intellectual property laws and treaties. The Product is not sold; it is licensed as a single product. You do not become the owner of the Product. As between you and UAB FOTONIJA (hereinafter referred to as the "Parties"), UAB FOTONIJA retains all title to the Product and all copies thereof.

By installing, copying, or otherwise using the Product you agree to be bound by the terms of this License Agreement. You agree that the Product is protected by a lock and cannot be used except in conjunction with a valid License Key issued by or on behalf of UAB FOTONIJA. In no event will Licensee deactivate the security codes of the License Key.

You acknowledge that under this Agreement you obtain only the following non-exclusive rights:

you can install and use indefinitely one copy of the Product on a single computer if not otherwise specified in a License Certificate by UAB FOTONIJA (the Product is used on a computer if it is loaded into the volatile memory or installed in non-volatile memory, for example, hard disk or other storage device); you can also install a second copy on a portable device also owned by the Licensee for the sole use of the person who is the primary user of the first copy, however, the Product can never be used simultaneously on both computers;
you may make a single copy of the software of the Product for backup and archival purposes only provided that any copy must contain all proprietary notices included in the original;
you may permanently transfer all your rights to use the Product to another person or entity provided you transfer this Agreement, the License Certificate, the License Key, the Product, including all copies, updates and prior versions to such person or entity, and that you refrain from using the Product and retain no copies of it, including copies stored on computer and the recipient agrees to the terms of this license.

UAB FOTONIJA reserves all rights not expressly granted to you. A license for the Product may not be used concurrently on different computers, except as noted above. You may not sublicense, rent, lease, lend, post, upload, publish (including publishing on the Internet), transmit, or otherwise distribute the License Key, the Product or any part of it. In order to publish the Product or spread the results of its operation on the Internet, local area network, wide area network or any other network or by any means of communication, you must make a special license agreement with UAB FOTONIJA. You may not make the License Key, the Product or any part of it available in any form whatsoever to a third party, except as expressly provided in this Agreement. The component parts of the Product may not be separated or used on more than one computer. You shall not reverse engineer, decompile, disassemble or otherwise attempt to discover the source code or data of the Product except to the extent you may be expressly permitted to decompile under applicable law. You shall not modify, adapt, translate the Product or make any other derivative works of it.

You acknowledge that the Product may contain bugs, its content may be inaccurate, and its operation not always smooth. The Product is supplied as is, with no explicit or implicit warranty, and you assume the entire risk of using the Product. To the full extent allowed by law UAB FOTONIJA also excludes for itself and its suppliers any liability, whether based in contract or tort (including negligence), to you or third parties for incidental, consequential, indirect, punitive or other damages of any kind, including loss of profits or savings, arising out of or in connection with use of the Product.

You must acquaint your employees or other persons which may use the Product or copies thereof in your premises with all terms and conditions of this License Agreement as well as ensure strict compliance with this agreement. If you do not agree to the terms of this License Agreement, do not install, copy or use the Product and remove the Product from your computer. If you breach any terms of the License Agreement, your rights to the Product under this License automatically terminate and you should remove the Product from your computer.
